ಮಾರ್ಚ್‌ 13 ರಂದು ಸುಪ್ರೀಂ ಕೋರ್ಟ್‌ (Stay From Supreme Court) ಈ ಪರೀಕ್ಷೆಗೆ ತಡೆಯಾಜ್ಞೆ ನೀಡಿ ಹೈಕೋರ್ಟ್‌ನಲ್ಲಿ ಮೇಲ್ಮನವಿ ಅರ್ಜಿಯ ವಿಚಾರಣೆ ನಡೆಸಿ ತೀರ್ಪು ನೀಡುವಂತೆ ಹೇಳಿತ್ತು. ಮಾರ್ಚ್‌ 18 ಕ್ಕೆ ಕಾಯ್ದಿರಿಸಿದ ತೀರ್ಪು ಇಂದು ಬೆಳಗ್ಗೆ 10.30 ಕ್ಕೆ ಪ್ರಕಟವಾಗಲಿದೆ ಎಂದು ತಿಳಿದು ಬಂದಿತ್ತು.

ರಾಜ್ಯದ 5, 8, 9, 11ನೇ ತರಗತಿ ಬೋರ್ಡ್ ಪರೀಕ್ಷೆ ವಿಚಾರಕ್ಕೆ ಸಂಬಂಧಿಸಿದಂತೆ ಇಂದು ಹೈಕೋರ್ಟ್ ವಿಭಾಗೀಯ ಪೀಠ ತೀರ್ಪು ಪ್ರಕಟಿಸಿದೆ. ರಾಜ್ಯದ 5, 8, 9,11 ನೇ ತರಗತಿ ಬೋರ್ಡ್ ಪರೀಕ್ಷೆ ನಡೆಸಲು ಹೈಕೋರ್ಟ್ ಅಸ್ತು ಎಂದಿದೆ. ಈ ಮೂಲಕ ನಿಂತು ಹೋಗಿದ್ದ ಪರೀಕ್ಷೆ ಮಾಡಲು ಹೈಕೋರ್ಟ್ ಆದೇಶ ಹೊರಡಿಸಿದೆ. ಮುಂದಿನ ಪರೀಕ್ಷೆಯ ವೇಳೆ ಸಂಬಂಧಪಟ್ಟವರೊಂದಿಗೆ ಸಮಾಲೋಚನೆ ನಡೆಸಲು ಹೈಕೋರ್ಟ್ ಶಿಕ್ಷಣ ಇಲಾಖೆಗೆ ಸೂಚನೆ ನೀಡಿದೆ.
ನ್ಯಾ.ಕೆ.ಸೋಮಶೇಖರ್‌, ನ್ಯಾ.ಕೆ.ರಾಜೇಶ್‌ ರೈ ಇದ್ದ ಹೈಕೋರ್ಟ್ ವಿಭಾಗೀಯ ಪೀಠ ತೀರ್ಪು ಪ್ರಕಟ ಮಾಡಿದೆ. ವಿಚಾರಣೆ ನಡೆಸಿದ ವಿಭಾಗೀಯ ಪೀಠ, ಬೋರ್ಡ್ ಪರೀಕ್ಷೆಗಳನ್ನು ನಡೆಸಲು ಅನುಮತಿ ನೀಡಿದ್ದು, ಸ್ಥಗಿತಗೊಂಡ ಪರೀಕ್ಷೆ ಮುಂದುವರೆಸಲು ಸೂಚನೆ ನೀಡಿದೆ.
ಈ ಮೂಲಕ 5,8,9 ನೇ ತರಗತಿ ಮಕ್ಕಳಿಗೆ ಪಬ್ಲಿಕೆ ಪರೀಕ್ಷೆಗೆ ಹೈಕೋರ್ಟ್ ಗ್ರೀನ್‌ ಸಿಗ್ನಲ್‌ ನೀಡಿದ್ದು, ಸೋಮವಾರದಿಂದ ಎಕ್ಸಾಂ ನಡೆಯಲಿದೆ. ಈಗಾಗಲೇ ಐದನೇ ತರಗತಿ ನಾಲ್ಕು ವಿಷಯಗಳ ಪರೀಕ್ಷೆ ಆಗಿದೆ. 8,9 ತರಗತಿಗಳದ್ದು ಎರಡೆರಡು ವಿಷಯಗಳ ಪರೀಕ್ಷೆ ಆಗಿದೆ. 11 ನೇ ತರಗತಿ ಎಲ್ಲಾ ವಿಷಯಗಳ ಪರೀಕ್ಷೆ ಮುಗಿದಿದ್ದು, ಫಲಿತಾಂಶವಷ್ಟೇ ಬಾಕಿ ಇದೆ. ಹಾಗಾಗಿ 5,8,9 ನೇ ತರಗತಿಯ ಉಳಿದ ಪರೀಕ್ಷೆಗಳನ್ನು ಸೋಮವಾರದಿಂದ ನಡೆಸುವ ಕುರಿತು ಕೋರ್ಟ್‌ಗೆ ಸರಕಾರ ಮಾಹಿತಿ ನೀಡಿದೆ.
ಏನಿದು ಪ್ರಕರಣ: ಕರ್ನಾಟಕ ಶಿಕ್ಷಣ ಕಾಯಿದೆಯಡಿ ರಾಜ್ಯ ಶಿಕ್ಷಣ ಇಲಾಖೆ 2023ರ ಅ.6 ಮತ್ತು 9 ರಂದು ಎರಡು ಸುತ್ತೋಲೆಗಳನ್ನು ಹೊರಡಿಸಿ 5, 8, 9 ಮತ್ತು 11ನೇ ತರಗತಿಗಳಿಗೆ ಬೋರ್ಡ್ ಮಟ್ಟದ ಪರೀಕ್ಷೆನಡೆಸುವುದಕ್ಕೆ ತೀರ್ಮಾನಿಸಿತ್ತು.
ಅದನ್ನು ಪ್ರಶ್ನಿಸಿದ್ದ ಅರ್ಜಿದಾರರ ಸಂಘಗಳು, “ಸರಕಾರದ ಈ ಸುತ್ತೋಲೆ ಕಡ್ಡಾಯ ಶಿಕ್ಷಣ ಹಕ್ಕು ಕಾಯಿದೆ ಸೆಕ್ಷನ್ 30 ಮತ್ತು – ಕರ್ನಾಟಕ ಶಿಕ್ಷಣ ಕಾಯಿದೆಯ ವಿವಿಧ ಸೆಕ್ಷನ್ ಗಳ ಉಲ್ಲಂಘನೆ ಯಾಗಿದ್ದು, ಬೋರ್ಡ್ ಪರೀಕ್ಷೆ ರದ್ದುಪಡಿಸಬೇಕು,” ಎಂದು ಕೋರಿದ್ದರು. ಈ ಅರ್ಜಿಗಳ ವಿಚಾರಣೆ ನಡೆಸಿದ್ದ ಏಕಸದಸ್ಯ ಪೀಠ, ಶಿಕ್ಷಣ ಇಲಾಖೆಯ ಸುತ್ತೋಲೆಗಳನ್ನು ರದ್ದುಪಡಿಸಿತ್ತು.
ಏಕಸದಸ್ಯ ಪೀಠದ ಆದೇಶ ಪ್ರಶ್ನಿಸಿ ಸರಕಾರ ವಿಭಾಗೀಯ ಪೀಠಕ್ಕೆ ಮೇಲ್ಮನವಿ ಸಲ್ಲಿಸಿತ್ತು. ಮೇಲ್ಮನವಿ ವಿಚಾರಣೆ ನಡೆಸಿದ್ದ ವಿಭಾಗೀಯ ಪೀಠ, ಏಕಸದಸ್ಯ ಪೀಠದ ಆದೇಶಕ್ಕೆ ತಡೆ ನೀಡಿ ಪರೀಕ್ಷೆ ನಡೆಸಲು ಅನುಮತಿ ನೀಡಿತ್ತು. ಅದನ್ನು ಅರ್ಜಿದಾರರು ಸುಪ್ರೀಂಕೋರ್ಟ್‌ಗೆ ವಿಶೇಷ ಮೇಲ್ಮನವಿ ಸಲ್ಲಿಸಿದ್ದರು. ವಿಭಾಗೀಯ ಪೀಠ ಆದೇಶಕ್ಕೆ ತಡೆ ನೀಡಿದ್ದ ಸುಪ್ರೀಂಕೋರ್ಟ್, ಸರಕಾರ ಸಲ್ಲಿಸಿರುವ ಮೇಲ್ಮನವಿಯನ್ನು ಸಮಗ್ರ ವಿಚಾರಣೆ ನಡೆಸಿ ಆದಷ್ಟು ಶೀಘ್ರ ತೀರ್ಪು ನೀಡುವಂತೆ ಸೂಚಿಸಿತ್ತು.
